If you got a DUI and you requested a driver’s license hearing (known as an “express consent hearing in DUI cases) at DMV following the DUI, the hearing must be scheduled within 60 days of your request date. Be aware that the DMV is unforgiving of any reason that you or your attorney have for needing to reschedule your hearing beyond the 60 day window – it will not happen. On the other hand, if the police officer subpoenaed for the hearing or the hearing officer who presides over the hearing request the hearing to be held outside of 60 days, the DMV will reschedule the hearing outside 60 days.
